We are often faced with the predicament in which trustees of an existing trust find themselves when they want to amend the Deed of Trust and the Deed stipulates that the Founder/Settlor/Donor, whilst alive, must be a party to the agreement to amend.
Once a trust agreement is created, the trustee has the most time-consuming role. The trustee's job is to hold, manage, and administer the funds in the trust on behalf of the decedent's estate. Their fiduciary duty as a trustee requires them to act in the best interest of the beneficiaries of the trust.
A trustee is a person or firm that holds and administers property or assets for the benefit of a third party. A trustee may be appointed for various purposes, such as in the case of bankruptcy, for a charity, or for a trust fund.
